By accessing or using YesMAM.shop ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including creators (influencers), vendors (sellers), customers, and visitors.
YesMAM.shop is an Africa-first creator commerce platform operated by EHR Creator Commerce ("we," "us," or "our"). The Platform connects TikTok and social media creators with local vendors in Ghana and across Africa, enabling creators to earn commissions on product sales driven through their personal storefronts.
Creators who register on the Platform may connect their TikTok account using TikTok's official Login Kit. By connecting your TikTok account, you authorize YesMAM to access your TikTok profile information (display name, avatar, bio, follower count, and public video list) solely to populate and maintain your YesMAM storefront. You may disconnect your TikTok account at any time, which will revoke YesMAM's access to your TikTok data. Creators are responsible for the accuracy of their profile information and for complying with TikTok's Terms of Service.
Vendors who list products on the Platform agree that their product descriptions, pricing, and inventory information are accurate. Vendors are responsible for fulfilling orders within the agreed service level agreement (SLA). YesMAM collects payment on behalf of vendors and remits the agreed wholesale price on a payout schedule. Vendors will not receive payment for orders that are cancelled, undelivered, or subject to a verified customer dispute.
Creators earn a commission on each completed sale driven through their storefront tracking link. Commission rates are defined per vendor affiliate program and displayed in the creator dashboard. Commissions are earned only on orders with status "delivered." YesMAM retains 50% of the affiliate fee on all transactions as a platform fee. Payouts are processed via MTN MoMo or other supported payment methods and are subject to minimum payout thresholds.
By placing an order on YesMAM.shop, customers agree to provide accurate delivery information and to pay the full order amount including applicable shipping and handling fees. Orders are fulfilled by vendors; YesMAM facilitates the transaction but does not hold inventory. Customers should contact YesMAM support for order issues, refund requests, or delivery disputes. YesMAM will mediate disputes between customers and vendors in good faith.
You may not use the Platform to: (a) violate any applicable law or regulation; (b) post false, misleading, or fraudulent product information; (c) circumvent the commission tracking system; (d) harvest or scrape user data; (e) interfere with Platform security or availability; (f) impersonate another person or entity. Violations may result in immediate account suspension without refund of pending commissions.
YesMAM.shop and its content (excluding user-generated content and vendor product listings) are owned by EHR Creator Commerce. Creators retain ownership of their personal content. By uploading content to the Platform, you grant YesMAM a non-exclusive, royalty-free license to display that content in connection with the operation of the Platform.
YesMAM uses TikTok's official Login Kit API to enable creators to connect their TikTok accounts. TikTok data accessed through this integration is used solely for the purpose described in Section 3 and our Privacy Policy. YesMAM does not share TikTok user data with third parties. YesMAM's use of TikTok APIs complies with TikTok's Platform Policy and Developer Terms of Service.
The Platform is provided "as is" without warranties of any kind. YesMAM does not guarantee uninterrupted availability, the accuracy of vendor product listings, or delivery timelines. To the maximum extent permitted by applicable law, YesMAM shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. YesMAM's total liability to any user shall not exceed the total fees paid by or to that user in the 30 days preceding the claim.
We may update these Terms from time to time. If we make material changes, we will notify users via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Accra, Ghana.
